It will be recalled that Bayelsa State High Court of Nigeria, Ogbia Judicial Division in Suit No: OHC/23/2020 Between Comrade Isaac Moguana Odual & Another v. Comrade Kennedy Olorogun & Anor with 7 others on 24th day of July, 2020 by Hon. Justice Raphael Ajuwa granted an exparte Order of Injunction restraining Comrade Kennedy Olorogun, Arepade Ekisah and 7 other Electoral Committee members of the Ijaw Youth Council from conducting the IYC Central Zone election on the 25th of July 2020 pending the hearing of the motion on notice and the Court specifically ordered that the order elapse after seven days if the motion on notice is not filed and the court adjourned the matter to 31st of July 2020 for hearing of the motion but the day fell in a public holiday and the court has again adjourned the case to the 24th of September, 2020 for the hearing of the motion on notice. Attached herein are the order of court, the motion on notice, the Writ of Summons and the hearing notice which the defendants and their counsel, Michael Ekadi have been duly served.


Information at our disposal is that The 1st and 2nd defendants and seven other Electoral Committee members of the IYC have fixed this Saturday, 8th August to conduct the IYC Central Zone election which the Court has restrained and stopped from conducting the election pending the hearing of the motion.

I want to strongly state that any election conducted without vacating the order of court will amount to contempt of court and any one including the Kennedy Olorogun and all the Electoral Committee members who disobeyed the order of court will be cited for contempt.

‘Order of court no matter how stupid it is, it must be obeyed until set aside by the court or a Superior Court’ per Justice Tsoho in Ecobank, Otudeko case . See also the cases of Obade Obeya v. First Bank of Nigeria PLC reported in CA/192/2005, Mobil Oil of Nig. LTD v. Assan (1995)8NWLR (pt412)129.

We want to reiterate that any election done by the defendants will be a contempt of court and those who flouted the order of court will face the magestical powers of court to be cited for contempt and contempt carries a term of imprisonment.
