The judgment delivered yesterday by the five man panel led by Justice Garba Mohammed is a coup against Nigeria’s democracy. The judges rewrote Nigeria’s constitution and amended the electoral act to favour President Muhammadu Buhari and his Party, the APC.

President Buhari and his Party, the APC knew ahead of time the angle the judges will take. No wonder the 2nd and the 3rd Respondents (Muhammadu Buhari and the APC) hurriedly abandoned the case halfway, refused to present witnesses and could not properly articulate their final written addresses, knowing too well that the judges will complete the work for them. This is the darkest day in the history of our dear country, Nigeria.

The flip flop attitude of Justice Garba Mohammed while delivering the judgment also shows that he was not the author of the document. He was handed down the document to read, hence, his last minutes complaints that there was so many errors while reading the judgment. This is another confirmation that he truly did not know what was given to him to read.

The Judgment Has No Legs

The judgment has no legs in which it is standing. On one hand, the judges blamed the PDP and Atiku/Obi for not inviting the Army Secretary to testify in court on his video broadcast in 2014, in which he told the world that the army does not have President Buhari’s Certificate. In another breath, the judgment attributes credits in favour of President Buhari in the Army Secretary’s video, saying that the Secretary says Buhari has so so and so so numbers of credits and passes.

No More Educational Qualification

The judgment completely eliminates educational qualifications in our systems. By this judgment, one can easily swear to an affidavit that he/she attended so so and so school, without presenting his/her certificates, one can contest elections or be employed in government offices.

In the area of false information of a fundamental nature in aid of the President’s qualifications, the judges took their time defending President Buhari more than the President and the APC’s lawyer during the trial.

Nigeria is now a laughing stock in the committee of nations. The theory of separation of powers is shattered. Both the legislature and the judiciary are no longer independent, but an appendage of the executive.

Nigeria is in trouble.
