An FCT High Court presided over by Justice Peter Affen on Friday set aside an interim order of injunction restraining the Bayelsa State Independent Electoral Commission (BYSIEC) from conducting the August 10, 2019 local council election.

The judge ruled that his decision to set aside the interim order of injuction was based on want of territorial jurisdiction.

He also ruled that the interim order of injuction has lapsed and abated by operation of law and by virtue of Order 43 Rule 2 of the High Court of the Federal Capital Territory (Civil Procedure) Rules 28.

Justice Affen however did not award any cost against the claimants, one Micah Akeems and the National Rescue Movement (NRM).

Justice V.S Gaba of the High Court sitting in Kwali, Gwagwalada Division of the FCT had on July 3, 2019 restrained BYSIEC from conducting the council poll but with the latest ruling, the coast is now clear for the commission to proceed with the conduct of the election.

The latest ruling is coming few days after another High Court sitting in Yenagoa gave BYSIEC the go ahead to conduct the election after an out of court settlement agreement between parties in a suit instituted by Accord Party and nine others.
