The presidential candidate of the People’s Democratic Party (PDP), H.E Atiku Abubakar, has withdrawn his motion against the Independent National Electoral Commission, INEC at the Court of Appeal sitting in Abuja.
Atiku’s Counsel, Ifeanyi Ipoko, told the Court that the two motions have been overtaken by events.
One of the two matters slated for hearing was the motion on notice praying for leave of court to grant PDP access while INEC reconfigures its BVAS machines.
The second is a motion exparte, for substituted service of the processes on the respondents, who are INEC, the winner of the Presidential Election Bola Ahmed Tinubu and the APC.
The motion was struck out by the three man panel of justices because Counsel to INEC and APC did not object to the application.
