The ECOWAS Court of Justice will on Tuesday, 14th July 2020 deliver judgment in a case brought by a Judge of the High Court of the Federal Republic of Nigeria, Justice S.E Aladetoyinbo alleging the violation of his rights to fair hearing, dignity of the human person and degrading treatment among others.

In suit no ECW/CCJ/APP/27/18 filed before the Court on 14 June 2018, the plaintiff through his counsel urged the Court to hold the defendant liable for violation of his fundamental rights resulting from a warning letter issued to him by the National Judicial Council (NJC) and published with distortions in different media channels.

The plaintiff submitted that the letter of warning by the Council, which has responsibility for the appointment, promotion and discipline of judicial officers, originated from an improperly constituted investigative committee set up by the Council, an agent of the defendant.

He also averred that the proceedings of the investigative committee were also marred by irregularities, and that his ordeal was initiated by a petition from a dissatisfied judgment debtor in a land dispute matter he presided over.

He claimed that the letter constituted a grievous perversion of justice that has traumatized and demoralized him, destroyed his integrity as well as honour and respect built over three decades of meritorious service to the defendant.

The plaintiff is seeking the orders of the Court setting aside the letter of warning, the payment of 855,625,000 Nigerian Naira (Eight hundred and fifty-five million, six hundred twenty-five thousand naira) as general damages, another 12,230,750 Naira (twelve million, two hundred and thirty thousand, seven hundred and fifty naira) as cost of litigation as well as a formal apology, among others.
