The Social Democratic Party (SDP} in Bayelsa State and its State House of Assembly candidate in Ogbia constituency 1 Owudogo Tariam have withdrawn the case of allege non-eligibility and disqualification filed at the Federal High Court against the candidate of the All Progressive Congress *APC), Chief (Hon.) Ebiango Egain Okoba.

The SDP and its candidate, had in August,2022 in a suit numbered FMC/YNG/CS/193/202S, filed a case of non-eligibility and sought the order of the Federal High Court to declare the candidate of the All Progressive Congress (APC), Hon. Ebiango Egain Okoba not qualified to contest the 2023 State House of Assembly elections.

But in a dramatic twist, the SDP and its Candidate, who are the first and second respondent respectively, on the 2nd of December, 2022 filed a notice of withdrawal and discontinuance of the non-eligibility suit against the APC flag bearer, Hon. Ebiango Egain Okoba, the All Progressive Congress (APC) and the Independent National Electoral Commission (INEC).

According to the application filed and made available to NAIJA LIVE TV, titled “Notice of Withdrawal or discontinuance brought pursuant to Order 50(1)(2) of the Federal High Court Civil Procedure Rules 2019 and under the Inherent Jurisdiction of this Honorable court”, stated that “they are seeking the leave of the Court to withdraw the suit no: FHC/YNG/CS/193/2022 filed on the 3rd of August,2022 between Social Democratic Party (SDP)&ANOR V Egain Okoba Ebianco&2 ors”

“And for such order or further orders as Honourable Court may deem fit to make in the circumstance.”
